WHEREAS, default has occurred in the performance of the covenants, terms, and conditions of a Deed of Trust Note dated December 17, 2013, and the Deed of Trust of even date securing the same, recorded December 18, 2013, in Book No. 657, at Page 483, in Office of the Register of Deeds for Lauderdale County, Tennessee,executed by Jonathan Scott and Crystal Scott, conveying certain property therein described to John C. Clark as Trustee for Mortgage Electronic Registration Systems, Inc., as beneficiary, as nominee for First State Bank, its successors and assigns; and the undersigned, Wilson & Associates, P.L.L.C., having been appointed Successor Trustee by PennyMac Loan Services, LLC.

NOW, THEREFORE, notice is hereby given that the entire indebtedness has been declared due and payable; and that an agent of Wilson & Associates, P.L.L.C.,as Successor Trustee, by virtue of the power, duty, and authority vested in and imposed upon said Successor Trustee, by PennyMac Loan Services, LLC, will, on January 29, 2020 on or about 10:00 AM, at theLauderdale County Courthouse, Ripley, Tennessee, offer for sale certain property hereinafterdescribed to the highest bidder FOR certified fundspaid at the conclusion of the sale, or credit bid from a bank or other lending entity pre-approved by the successor trustee. The sale is free from all exemptions, which are expressly waived in the Deed of Trust, said property being real estate situated in Lauderdale County, Tennessee,and being more particularly described as follows:

Being Lot #39 of Cottonwood Acres Subdivision, Ripley, Tennessee, as shown on plat recorded in Plat Cabinet #1, slide 15, of the Register’s Office of Lauderdale County, Tennessee. BEGINNING at a point in the west right of way line of Sherrin Drive (having a 50 foot right of way), said point being the northeast corner of Lot #38 and the southeast corner of Lot #39, Cottonwood Acres Subdivision, now being described, runs thence with the north line of Lot #38, South 86 degrees 49′ 00″ West 150.00 feet to an iron pin, subject lot’s (Lot #39) southwest corner and the northwest corner of Lot #38, said point being the northeast corner of Lot #53 and the southeast corner of Lot #52; thence with the east line of Lot #52. North 3 degrees 22′ 00″ West 100.00 feet to an iron pin, subject lot’s northwest corner and the northeast corner of Lot #52, said point being the southeast corner of Lot #51 and the southwest corner of Lot #40; thence with the south line of Lot #40, North 86 degrees 49′ 00″ East 150.00 feet to a point in the west right of way line of Sherrin Drive, subject lot’s northeast corner and the southeast corner of Lot #40; thence with the west right of way line of Sherrin Drive, South 3 degrees 22′ 00″ East 100.00 feet to the point of beginning and containing 0.34 acre, more or less. Subject to restrictions of Cottonwood Acres Subdivision found of record in Book 297, page 119 of the Register’s Office of Lauderdale County, Tennessee, Being designated as Map 94L, Group C, Parcel 31 in accordance with the Tax Assessor’s Office of Lauderdale County, Tennessee.

This sale is subject to all matters shown on any applicable recorded plat; any unpaid taxes; any restrictive covenants, easements, or setback lines that may be applicable; any statutory rights of redemption of any governmental agency, state or federal; any prior liens or encumbrances as well as any priority created by a fixture filing; and to any matter that an accurate survey of the premises might disclose. The sale held pursuant to this Notice may be rescinded at the Successor Trustee’s option at any time.
