SUBSTITUTE TRUSTEE’S NOTICE OF SALE
Sale at public auction will be on April 29, 2020, at or about 10:00 AM, local time, at the front door of the Lauderdale County Courthouse, 100 Court Square, Ripley, TN 38063, pursuant to the Deed of Trust executed by Christopher M. Carver, an unmarried man, to FMLS, Inc., as Trustee for Regions Bank d/b/a Regions Mortgage dated May 28, 2013, and recorded in Record Book 650, Page 439, in the Register’s Office for Lauderdale County, Tennessee (“Deed of Trust”), conducted by Padgett Law Group, having been appointed Substitute Trustee, all of record in the Lauderdale County Register’s Office. Default in the performance of the covenants, terms, and conditions of said Deed of Trust has been made; and the entire indebtedness has been declared due and payable.

The hereinafter described real property located in Lauderdale County will be sold to the highest call bidder subject to all unpaid taxes, prior liens and encumbrances of record:
Legal Description: Lying, situated and being in the 6th Civil District of Lauderdale County, Tennessee, and more particularly described as follows, to-wit:
Beginning at a stake at the southwest corner of Bobby Webbs lot and being in the north margin of a street; thence North 300 feet along Webbs and Koonces west line to blacktop road; thence West 110 feet parallel with said road to a stake; thence South parallel with Webbs and Koonces west line 300 feet to a stake in the north margin of said street; thence East 110 feet along said street to the point of beginning, containing 33,000 square feet more or less. This conveyance is made subject to existing utility easements as shown on said recorded plat. No trailers shall be allowed to be placed on said property for residential purposes. EXCLUSION: Included in the above description, but excluded from this conveyance, is a tract of land conveyed to Jerry Glover and wife, Linda Glover, by deed recorded in Book 282, page 121 of the Registers Office of Lauderdale County, Tennessee, and more particularly described as follows, to-wit:
Beginning at a stake in the southwest right-of-way line of Cedar Grove Road (having a 60 foot right-of-way), said point being a common corner of Lot #4, Cedar Village Subdivision and Steve Meadows and wife, Beverly Meadowslot (Lot #5, Cedar Village Subdivision) of which this lot, now being described, is a portion; runs thence with the northwest line of Lot #4 and the southeast line of Meadows lot (Lot #5), South 45 degrees 00West 130.00 feet to a stake, subject lots southwest corner; thence across Meadowslot (Lot #5) and parallel to the right-of-way line of the Cedar Grove Road, North 45 degrees 00 West 110.00 feet to a stake in the southeast line of Lot #6, Cedar Grove Subdivision; thence with the southeast line of Lot #6 and parallel to the southeast line of subject lot, North 45 degrees 00East 130.00 feet to a stake in the southwest right-of-way line of the Cedar Grove Road, common corner with Lot #6 and subject lot; thence with the southwest right-of-way line of the Cedar Grove Road, South 45 degrees 00 East 110.00 feet to the point of beginning.
Street Address: The street address of the property is believed to be 136 Barry White Lane, Ripley, TN 38063, but such address is not part of the legal description of the property. In the event of any discrepancy, the legal description herein shall control.

This sale is subject to all matters shown on any applicable recorded Plat or Plan; any unpaid taxes and assessments; any restrictive covenants, easements or setback lines that may be applicable; rights of redemption, equity, statutory or otherwise, not otherwise waived in the Deed of Trust, including rights of redemption of any government agency, state or federal; and any and all prior deeds of trust, liens, dues, assessments, encumbrances, defects, adverse claims and other matters that may take priority over the Deed of Trust upon which this foreclosure sale is conducted or are not extinguished by this Foreclosure Sale.
THE PROPERTY IS SOLD WITHOUT ANY REPRESENTATIONS OR WARRANTIES, EXPRESSED OR IMPLIED, RELATING TO TITLE, MARKETABILITY OF TITLE, POSSESSION, QUIET ENJOYMENT OR THE LIKE AND FITNESS FOR A GENERAL OR PARTICULAR USE OR PURPOSE. The title is believed to be good, but the undersigned will sell and convey only as Substitute Trustee.
The right is reserved to adjourn the sale to another time certain or to another day, time, and place certain, without further publication upon announcement on the day, time, and place of sale set forth above or any subsequent adjourned day, time, and place of sale.
If you purchase a property at the foreclosure sale, the entire purchase price is due and payable at the conclusion of the auction in the form of a certified check made payable to or endorsed to Padgett Law Group. No personal checks will be accepted. To this end, you must bring sufficient funds to outbid the lender and any other bidders. Insufficient funds will not be accepted. Amounts received in excess of the winning bid will be refunded to the successful purchaser at the time the foreclosure deed is delivered.
