WHEREAS, default has occurred in the performance of the covenants, terms, and conditions of a Deed of Trust Note dated April 30, 1998, and the Deed of Trust of even date securing the same, recorded April 30, 1998, in Book No. 396, at Page 31, in Office of the Register of Deeds for Lauderdale County, Tennessee,executed by Donald David Marcy and Evelyn Marcy, conveying certain property therein described to Katie Winchester as Trustee for First Citizens National Bank; and the undersigned, Wilson & Associates, P.L.L.C., having been appointed Successor Trustee by Towd Point Master Funding Trust 2021-PM1.

NOW, THEREFORE, notice is hereby given that the entire indebtedness has been declared due and payable; and that an agent of Wilson & Associates, P.L.L.C.,as Successor Trustee, by virtue of the power, duty, and authority vested in and imposed upon said Successor Trustee, by Towd Point Master Funding Trust 2021-PM1, will, on September 22, 2021 on or about 10:00AM, at the Lauderdale County Courthouse, Ripley, Tennessee, offer for sale certain propertyhereinafter described to the highest bidder FOR certified fundspaid at the conclusion of the sale, or credit bid from a bank or other lending entity pre-approved by the successor trustee. The sale is free from all exemptions, which are expressly waived in the Deed of Trust, said property being real estate situated in Lauderdale County, Tennessee,and being more particularly described as follows:

Lying, situated and being in the 2nd Civil District of Lauderdale County, Tennessee, and more particularly described as follows, to-wit: Being Lot No. 3, Hillcrest Subdivision, Deed Book 12, page 451, Register’s Office of Lauderdale County, Tennessee, Beginning at a concrete marker, said marker being 211.4 feet along the south margin of Church Street from the east margin of Alpine Street, said marker being the northeast corner of Lot No. 2 Hillcrest Subdivision, Section 1, being the northwest corner of the herein described lot; runs thence with the south margin of Church Street North 86 degrees 50 minutes East 80.0 feet to a power pole; runs thence with the west line of Lot No. 4 South 1 degree 30 minutes East 209.5 feet to a stake; runs thence with the north line of Lot No. 11, (Givens) South 89 degrees 00 minutes West 80.0 feet to a stake; runs thence with the east line of Lot NO. 2 North 1 degree 30 minutes west 206.5 feet to the beginning, containing 0.38 acre, more or less. This sale is subject to all matters shown on any applicable recorded plat; any unpaid taxes; any restrictive covenants, easements, or setback lines that may be applicable; any statutory rights of redemption of any governmental agency, state or federal; any prior liens or encumbrances as well as any priority created by a fixture filing; and to any matter that an accurate survey of the premises might disclose. The sale held pursuant to this Notice may be rescinded at the Successor Trustee’s option at any time.
