NOTICE OF TRUSTEE’S SALE

WHEREAS, default has occurred in the performance of the covenants, terms, and conditions of a Deed of Trust Note dated February 22, 2008, and the Deed of Trust of even date securing the same, recorded February 25, 2008, in Book No. 583, at Page 775, in Office of the Register of Deeds for Lauderdale County, Tennessee, executed by Montgomery Alston, conveying certain property therein described to L Bruner as Trustee for CitiFinancial Services, Inc.; and the undersigned, Foundation Legal Group, LLP fka Wilson & Associates, P.L.L.C., having been appointed Successor Trustee by U.S. Bank Trust Company, National Association, not in its individual capacity but solely in its capacity as Indenture Trustee of CIM Trust 2025-NR1.

NOW, THEREFORE, notice is hereby given that the entire indebtedness has been declared due and payable; and that an agent of Foundation Legal Group, LLP fka Wilson & Associates, P.L.L.C., as Successor Trustee, by virtue of the power, duty, and authority vested in and imposed upon said Successor Trustee, by U.S. Bank Trust Company, National Association, not in its individual capacity but solely in its capacity as Indenture Trustee of CIM Trust 2025-NR1, will, on January 7, 2026 on or about 10:00 AM, at the Front Door of the Lauderdale County Courthouse 100 Court Square, Ripley, TN 38063, offer for sale certain property hereinafter described to the highest bidder FOR certified funds paid at the conclusion of the sale, or credit bid from a bank or other lending entity pre-approved by the successor trustee. The sale is free from all redemptions, which are expressly waived in the Deed of Trust, said property being real estate situated in Lauderdale County, Tennessee, and being more particularly described as follows:

DAISY OLDHAM; THENCE EAST 1.6 CHAINS TO A STAKE; THENCE NORTH PARALLEL TO THE WESTERN BOUNDARY OF THIS LOT A DISTANCE OF 1.50 CHAINS TO A STAKE IN JETER’S SOUTH LINE; THENCE WEST 1.575 CHAINS TO THE POINT OF BEGINNING. AND BEING THE WESTERN ONE-HALF OF A LOT IN WHICH AN UNDIVIDED ONE-HALF INTEREST WAS CONVEYED TO MONTGOMERY ALSTON BY DEED OF CALLIE MAE ALSTON.  THE FOLLOWING DESCRIBED REAL ESTATE, TOGETHER WITH ALL IMPROVEMENTS THEREON, LYING, SITUATE AND BEING IN THE 3RD CIVIL DISTRICT OF

LAUDERDALE COUNTY, TENNESSEE, AND MORE PARTICULARLY BOUNDED AND DESCRIBED AS FOLLOWS, TO-WIT: BEGINNING AT A STAKE IN THE NORTH MARGIN OF THE ORIGINAL TRACT, SAID POINT OF BEGINNING BEING THE NORTHEAST CORNER OF MONTGOMERY ALSTONS LOT AND BEING 1.575 CHAINS EAST OF THE NORTHWEST CORNER OF THE ORIGINAL TRACT OF WHICH THIS LOT IS A PARCEL; THENCE SOUTH WITH MONTGOMERY ALSTONS EAST LINE 1.50 CHAINS TO A STAKE IN THE SOUTH BOUNDARY LINE OF THE ORIGINAL TRACT; THENCE EAST 1.6 CHAINS TO A STAKE IN THE BOUNDARY OF A LOT BELONGING TO EVA DELL CONLEY; THENCE NORTH ALONG THE WEST BOUNDARY OF LOTS BELONGING TO EVA DELL CONLEY AND GEORGE TURNER IN THAT ORDER 1.50 CHAINS TO A POST IN THE WEST BOUNDARY OF GEORGE TURNERS LOT, THE SAME BEING THE SOUTHEAST CORNER OF JAMES AND IONIE GEATERS (JETERS) LOT; THENCE WEST 1,575 CHAINS TO THE POINT OF BEGINNING, AND BEING THE EASTERN ONE-HALF OF THE LOT CONVEYED TO CALLIE MAE ALSTON AND EMMETT ALSTON BY DEED OF JAMES JETER AND RECORD IN RECORD BOOK 42. PAGE 476, REGISTERS OFFICE OF LAUDERDALE COUNTY, TENNESSEE.

This sale is subject to all matters shown on any applicable recorded plat; any unpaid taxes; any restrictive covenants, easements, or setback lines that may be applicable; any statutory rights of redemption of any governmental agency, state or federal; any prior liens or encumbrances as well as any priority created by a fixture filing; and to any matter that an accurate survey of the premises might disclose. The sale held pursuant to this Notice may be rescinded at the Successor Trustee’s option at any time.
