NOTICE OF TRUSTEE’S SALE
WHEREAS, default has occurred in the performance of the covenants, terms, and conditions of a Deed of Trust Note dated December 5, 2007, and the Deed of Trust of even date securing the same, recorded December 7, 2007, in Book No. 580, at Page 354, in Office of the Register of Deeds for Lauderdale County, Tennessee, executed by John Gaddy, conveying certain property therein described to M Rushing as Trustee for CitiFinancial Services, Inc.; and the undersigned, Wilson & Associates, P.L.L.C., having been appointed Successor Trustee by Wilmington Savings Fund Society, FSB, not in its individual capacity but solely as Indenture Trustee of CIM Trust 2023-R3.
NOW, THEREFORE, notice is hereby given that the entire indebtedness has been declared due and payable; and that an agent of Wilson & Associates, P.L.L.C., as Successor Trustee, by virtue of the power, duty, and authority vested in and imposed upon said Successor Trustee, by Wilmington Savings Fund Society, FSB, not in its individual capacity but solely as Indenture Trustee of CIM Trust 2023-R3, will, on July 3, 2024 on or about 10:00 AM, at the Front Door of the Lauderdale County Courthouse 100 Court Square, Ripley, TN 38063, offer for sale certain property hereinafter described to the highest bidder FOR certified funds paid at the conclusion of the sale, or credit bid from a bank or other lending entity pre-approved by the successor trustee. The sale is free from all exemptions, which are expressly waived in the Deed of Trust, said property being real estate situated in Lauderdale County, Tennessee, and being more particularly described as follows:
TRACT 1: 077 026.01 Beginning at a stake in the old abandoned Ripley- Ashport roadbed, said stake being a southeast corner of the Conner 119.5 acre tract, also being a corner of the Wiley T. Daniels tract, same being the north line of Daniels, north 62° east 139.00 feet to a point in the center of the Highway #19; thence with the center of Highway #19, north 42° west 80.00 feet to a point in the center of said road; thence south 60-1/4° west 119.00 feet to a stake in the center of said old abandoned roadbed, same being the south line of said 119.5 acre tract; thence with the center of said roadbed, South 28-1/4° east
75.00 feet to the beginning and containing 1/4 acre, more or less. TRACT 2: 077 026.03 Beginning at John Gaddy’s northeast corner in the centerline of Highway 19 West; thence with Caddy’s north line South 60 degrees 15 minutes 00 seconds West 119.00 feet to a point in the old abandoned road being the northwest corner of Gaddy’s lot and being the southwest corner of this described lot; thence North 30 degrees 52 minutes 07 seconds West 118.42 feet to an iron stake being the northwest corner of this described lot and new inner corner of Conner’s tract; thence North 49 degrees 24 minutes 42 seconds East
93.46 feet to a RK. nail in the centerline of Highway 19 West being the northeast corner of this described lot; thence South 42 degrees 00 minutes 00 seconds East 139.14 feet to the point of beginning, containing 0.311 acres more or less. This sale is subject to all matters shown on any applicable recorded plat; any unpaid taxes; any restrictive covenants, easements, or setback lines that may be applicable; any statutory rights of redemption of any governmental agency, state or federal; any prior liens or encumbrances as well as any priority created by a fixture filing; and to any matter that an accurate survey of the premises might disclose. The sale held pursuant to this Notice may be rescinded at the Successor Trustee’s option at any time. The right is reserved to adjourn the day of the sale to another day, time, and place certain without further publication, upon announcement at the time and place for the sale set forth above. In the event of inclement weather, the trustee hereby announces that the sale will be postponed and that notices of said postponement for inclement weather will be mailed to interested parties of record.
